A crucial measure of success for a new president is the First Hundred Days – a period which reveals a new administration’s temperament, goals, and likelihood of lasting accomplishment. The term dates to 1933, when FDR ushered in a blizzard of legislation initiating the New Deal, fundamentally altering the relationship between the federal government and the American people.

We seem to be experiencing a similar moment, as President Trump attempts to re-shape the federal government through a barrage of executive orders, nominations, dismissals, pardons, tariffs – real and threatened – foreign policy initiatives and other measures that promise a new version of the Executive Branch never envisioned by the framers of our Constitution. This theory of the Unitary Executive as championed by the right wing will undoubtedly be tested in the courts.

It seems that the election was not the end of the process but rather the beginning of a renewed struggle over the future of our democracy. What are the chances of success without any of the traditional guardrails? Will the Congress, the Courts, or any other political group come to the aid of our Constitution and the rule of law?
